Food item launched by activist allegedly exploded and left mustard stain on immigration officer, trial told
A federal customs official has stated under oath he could sense through his ballistic vest the collision of a sandwich hurled at him by a DC demonstrator, who has stood before a judge for physical attack.
Immigration and customs agent the government official told the jury the food item "burst all over him" and he "could smell the vegetables and mustard" on his official attire.
Neither side contests that Sean Dunn, 37, did in fact lob vulgar language and a deli-style sandwich at law enforcement sent by the administration to patrol the nation's capital in the summer month.
The incident was captured on camera and went viral, making Mr Dunn a symbol of opposition in the capital to the administration.
Government prosecutors at first tried to secure serious criminal counts against the defendant, but a legal panel chose not to indict him.
The former president's sending of military personnel to the federal district this warmer months caused protest from some of the DC citizens, who considered it a politicisation of the armed forces.
Based on charging documents, Mr Dunn came near a law enforcement team at about late evening on the summer date, referring to them "extremists" and yelling: "Why are you present? You are not welcome in my city!"
The legal proceeding witnessed a reenactment from Mr Lairmore on Tuesday as he testified against the defendant.
"I sensed it through my protective gear," he stated of the food's collision, adding that an vegetable piece hung from his communication device and sauce stained his clothing.
Mr Dunn's attorney, his legal representative, argued in her initial argument that hurling the sandwich was a "innocent action that did not, could not, create physical damage".
But prosecutor the state's representative said the accused must be considered responsible.
"No matter who you are, you should not throwing stuff at others because you're upset," Mr Parron said.
After the claimed attack was revealed, Mr Dunn was terminated from his job as a legal assistant in the federal legal agency.
